IMPORTANT LEGISLATIVE UPDATE IN THE MINNESOTA LEGISLATURE, From JBS (John Birch Society) :
We would like to update you on the status of several important bills in the Minnesota Legislature.
- Article V Convention
GREAT NEWS: Several Article V convention resolutions — and the push to open up the U.S. Constitution to radical revisions that could obliterate the God-given freedoms that it guarantees — have failed. This is a major win for the Constitution and liberty!
House File No. 667 (HF 667), Senate File No. 736 (SF 736), Senate File No. 2617 (SF 2617), and Senate File No. 4502 (SF 4502) followed the wording of Mark Meckler’s Convention of States (COS) Project application, urging Congress to call a convention to propose amendments “that impose fiscal restraints on the federal government, limit the power and jurisdiction of the federal government, and limit the terms of office for its officials and for members of Congress.” Additionally, Senate File No. 226 (SF 226), a term-limits Con-Con resolution, was introduced.
Meanwhile, Senate File No. 4068 (SF 4068) and House File No. 4489 (HF 4489) was designed to give false assurance that a convention won’t get out of control, doing this by ostensibly regulating the appointment and conduct of delegates. Such a bill would be completely useless at preventing a runaway convention — for example, these resolutions don’t regulate delegates from other states, and don’t prevent delegates from proposing an entirely new constitution (in the 1787 Convention, states also attempted to limit delegates’ authority).
The truth is that any Con-Con could accomplish the same goals that many of its advocates claim to be fighting against. As evidence, 2016 and 2023 Convention of States (COS) controlled simulations resulted in amendments massively increasing the federal government and expanding its spending powers! Furthermore, term limits would do nothing to limit the federal government or improve our representation. For example, they would throw out the best congressmen along with the worst.
The late Supreme Court Justice Antonin Scalia understood the danger of a constitutional convention, stating in 2015 that “this is not a good century to write a constitution.”
Thankfully, none of these resolutions were voted on or were enacted. Since the 2024 session has adjourned, they are dead for the year. Please thank the legislators who opposed these resolutions, and urge them to remain steadfast in their opposition to a federal constitutional convention.
Congratulations! Your efforts to defend our Constitution have succeeded! Nonetheless, our vigilance and fight for freedom continues; these resolutions could be reintroduced and considered next year.
2) Nullification
We had been monitoring multiple strong nullification bills this year. These included Senate File No. 1072 (SF 1072), titled the “Defend the Guard Act.” If enacted, it would have prevented combat deployments of the Minnesota National Guard by the federal government in the absence of a congressional declaration of war or another constitutional reason in accordance with Article I, Section 8, Clauses 11 and 15, of the U.S. Constitution. In other words, SF 1072 would have been a strong step toward nullifying unconstitutional wars and severely hampering the federal government’s ability to further entangle the U.S. in any undeclared wars overseas. Unfortunately, the Legislature did not take action on SF 1072.
Meanwhile, Senate File No. 938 (SF 938) would have been a significant step toward nullifying federal vaccine passports and mandates in Minnesota. SF 938 declares in part:
To ensure the sovereignty of states’ rights guaranteed by the Tenth Amendment to the United States Constitution and to protect the fundamental individual liberties and privacies of all persons against an abusive federal government, no government entity or its subdivisions, agents, designees, or assigns shall have the authority to enforce or attempt to enforce any vaccine passport, pass, or credential in this state, whether by federal act, law, executive order, administrative order, court order, rule, regulation, statute, or ordinance.
Unfortunately, the Legislature did not take action on SF 938.
Please continue to contact and meet with your state legislators, urging them to enact legislation that enforces the U.S. Constitution and nullifies unconstitutional federal actions. Furthermore, show your legislators model nullification bills and urge them to enact such legislation.
3) Sound Money
We had been monitoring House File No. 106 (HF 106), which would have created a sales-tax exemption for bullion “coins and currency,” expanding an existing exemption for precious metals — an important step toward treating gold and silver as money, as the U.S. Constitution requires. Unfortunately, the Legislature did not take action on this bill.
Additionally, House File No. 3394 (HF 3394) would have amended the Minnesota’s definition of money, found in its Uniform Commercial Code, to exclude a potential central bank digital currency (CBDC), a major step toward pushing back against this dangerous proposal. Unfortunately, the Legislature did not take action on this bill.
Please continue informing your legislators about the importance of constitutional money, and urge them to take bold action to fully enforce the U.S. Constitution’s monetary provisions.
4) Agenda 2030
We had been monitoring House File No. (HF 4750) and Senate File No. (SF 4079), which would have banned state and local government agencies from implementing several globalist United Nations initiatives, including its 2030 Agenda for Sustainable Development. These bills would have been a great first step toward pushing back against Agenda 2030 in Minnesota. Unfortunately, the Legislature did not take action on this bill.
Please urge your legislators to oppose Agenda 2030 and to defend Minnesota and U.S. sovereignty — and our God-given freedoms — from international organizations such as the United Nations.
5) Other Legislation
We monitored House File No. 3947 (HF 3947) and Senate File No. 3852 (SF 3852), which (among other changes) amended Minnesota law to impose draconian restrictions on the ability of homeowners to make minor improvements to their own homes — a major expansion of government control. According to observers, these bills were the result of government officials working with labor unions. By government banning homeowners from doing work on their own homes, these unions would artificially create more business for their members. Unfortunately, the Legislature enacted — and Governor Tim Walz signed — SF 3852 into law.
We monitored House File No. 4598 (HF 4598) and Senate File No. 4785 (SF 4785), which would have proposed an amendment to the Minnesota Constitution to create an independent redistricting commission to redraw Minnesota’s state and federal districts, rather than the Legislature doing this. Such a commission would be a major step toward implementing technocracy at the state level. Thankfully, the Legislature did not pass these dangerous bills.
